Robert Martin Company, LLC (“RMC”, “Company”, “we”, “our”, or “us”) respects your privacy and is committed to protecting it through our compliance with this policy. This policy describes how we collect, process, retain, and disclose personal data about you when providing services to you through our website located at https://www.robertmartincompany.com/ and any services that link to this policy (our “Services”) and our practices for using, maintaining, protecting, and disclosing that information.

This policy applies only to information we collect:

•      Through the Services.

•      In communications, including email, text, and other electronic messages, between you and the Services.

It does not apply to information collected by:

•      Us through any other means, including on any other website operated by Company or any third party (including our affiliates and subsidiaries) that does not link to this policy; or

•      Any third party (including our affiliates and subsidiaries), including through any application or content (including advertising) that may link to or be accessible from or through the Services. This includes the RentCafe resident and applicant portal operated by Yardi Systems, Inc., which is described in more detail below.

We may provide additional or different privacy policies that are specific to certain features, services, or activities.

Please read this policy carefully to understand our policies and practices regarding your information and how we treat it. By interacting with our Services or providing us with your information, you agree to the collection, use, and sharing of your information as described in this privacy policy. This policy may change from time to time (see Changes to Our Privacy Policy below). Your continued use of the Services after we make changes as described here is deemed to be acceptance of those changes. Please check the policy periodically for updates.

Children’s and Minors’ Data

Our Services are not intended for, and we do not knowingly collect any personal data from, children under the age of 18. If we learn we have collected or received personal data from a child under 18 years old without verification of parental consent, we will delete that information.

The Personal Data That We Collect or Process

“Personal data” is information that identifies, relates to, or describes, directly or indirectly, you as an individual, such as your name, email address, telephone number, or home address.

Our website does not offer user accounts, logins, or online forms that collect personal data. The types and categories of personal data we collect or process through the Services are limited to:

•      Contact information that you voluntarily provide to us when you contact us by email, telephone, or other electronic message, including your name, email address, phone number, and the contents of your message.

•      Device information, including your IP address, device identifiers, operating system and version, preferred language, browser type and settings, and other device information collected automatically as described below.

We also collect:

•      Statistics or aggregated information. Statistical or aggregated data does not directly identify a specific person, but we may derive non-personal statistical or aggregated data from personal data. For example, we may aggregate data to calculate the percentage of users accessing a specific Services feature.

•      Technical information. Technical information includes information about your internet connection and usage details about your interactions with the Services, such as clickstream information to, through, and from our Services (including date and time), properties or pages that you view or search for, page response times, download errors, length of your visits to certain pages, page interaction information (such as scrolling, clicks, and mouse-overs), or methods used to browse away from a page.

If we combine or connect non-personal statistical or technical data with personal data so that it directly or indirectly identifies an individual, we treat the combined information as personal data.

Sensitive personal data. We do not intentionally collect or process sensitive personal data through the Services. Sensitive personal data includes categories such as government-issued identifiers, precise geolocation, financial account information, racial or ethnic origin, religious or philosophical beliefs, health information, and account log-in credentials. We do not sell sensitive personal data or use it for purposes that would require us to offer a right to limit its use.

Sale and sharing of personal data. RMC does not sell your personal data, and RMC does not share your personal data for cross-context behavioral (targeted) advertising, in each case as those terms are defined under applicable state privacy laws, and RMC has not sold or shared personal data for these purposes in the preceding 12 months.

 

How We Collect Your Personal and Other Data

We collect information about you when you interact with our Services, such as when you contact us with an inquiry about one of our properties.

As you navigate through and interact with our Services, we may use automatic data collection technologies to collect information that may include personal data. Information collected automatically may include usage details, IP addresses, operating system, and browser type, and information collected through cookies, web beacons, and other tracking technologies including details of your interactions with our Services, such as traffic data, location data, logs, and other communication data, and which resources and Services features that you access and use.

We may use these automatic collection technologies to collect information about your online activities over time and across third-party sites or other online services (behavioral tracking).

Using automatic collection technologies helps us to improve our Services and to deliver a better and more personalized experience.

The technologies we use for this automatic data collection may include:

•      Cookies. A cookie is a small file placed on your device when you interact with the Services. You may refuse to accept or disable cookies by activating the appropriate setting on your browser or device. However, if you select this setting, you may be unable to access certain features of the Services.

•      Web Beacons. Some parts of the Services and our emails may contain small electronic files known as web beacons (also referred to as clear gifs, pixel tags, and single-pixel gifs) that permit the Company, for example, to count users who have visited those parts or opened an email and for other related statistics (for example, recording the popularity of certain content and verifying system and server integrity).

•      Google Analytics. RMC uses Google Analytics, a web analytics service provided by Google LLC ("Google"), only to collect aggregated, non-identifiable usage data to improve site performance and user experience. RMC does not use Google Analytics to collect information that identifies you as an individual.  For information on how Google collects and processes data when you use our Services, please visit "How Google Uses Information from Sites or Apps that Use Our Services" at https://policies.google.com/technologies/partner-sites. Google's ability to use and share information collected by Google Analytics is governed by the Google Analytics Terms of Service (https://marketingplatform.google.com/about/analytics/terms/us/) and Google's Privacy Policy (https://policies.google.com/privacy). You may opt out of Google Analytics tracking by installing the Google Analytics Opt-Out Browser Add-On, available at https://tools.google.com/dlpage/gaoptout. RMC has configured Google Analytics to be privacy-protective. Specifically:

         No Personal Identifiers: We do not share your name, email, or any other personal identifiers with Google.

         Advertising Features Disabled: We have disabled “Google Signals” and Remarketing features.

         IP Anonymization: Google Analytics is configured to anonymize IP addresses before storage, ensuring they are not linked to individual users.

         No IP Storage: Google does not log or store full IP addresses.

         Global Privacy Control (GPC): Our website is configured to recognize and honor Global Privacy Control (GPC) signals.

         Retention: Analytics data is retained for 12 months solely for trend analysis and site optimization.

         Opt Out: You can opt out of analytics tracking by enabling Global Privacy Control or using browser-based opt-out tools.

To the extent any of these automated technologies are considered a personal data sale, targeted advertising, or profiling under applicable laws, depending on where you live, you may opt out from use of these automated technologies for such uses by emailing your request to Office@rmcdev.com. Please note that some features may be unavailable as a result.

When you interact with the Services, there are third parties that may use automatic collection technologies to collect information about you or your device. These third parties include:

•      Advertisers, ad networks, and ad servers.

•      Analytics companies.

•      Your device manufacturer.

•      Your internet or mobile service provider.

These third parties may use tracking technologies to collect information about you when you use the Services. The information they collect may be associated with your personal data or they may collect information, including personal data, about your online activities over time and across different websites, apps, platforms, and other online services. While we respect your GPC settings, what information is communicated could be associated with other information to potentially identify you or your devices. They may use this information to provide you with interest-based (behavioral) advertising or other targeted content.

We do not control these third parties’ tracking technologies or how they may be used. If you have any questions about an advertisement or other targeted content, you should contact the responsible provider directly.

Your Consent to Automatic Data Collection. Some of the cookies, web beacons, analytics tools, and other tracking technologies used on the Services are provided by third-party vendors that monitor and analyze activity on the Services, and these vendors may capture, record, store, and process your interactions with the Services. When you first access the Services, we present a cookie and tracking-preferences banner that allows you to accept or decline these technologies before they are deployed, and we honor the preferences you select and any Global Privacy Control signal your browser sends. By selecting your preferences to allow these technologies, or by continuing to use the Services after receiving this notice, you consent to the collection, recording, and processing of your interactions with the Services by us and by our third-party vendors as described in this policy. You may withdraw your consent at any time by adjusting your cookie settings or by using the opt-out mechanisms described in this policy.

 

Resident and Applicant Portal (RentCafe / Yardi)

Our website links to a resident and applicant portal powered by RentCafe, a service operated by Yardi Systems, Inc. (“Yardi”). If you use the RentCafe portal to apply for a residence, pay rent, submit a maintenance request, or otherwise manage your tenancy, you will leave our website and personal information you provide will be collected and processed by Yardi on that platform.

The RentCafe portal is not part of our Services and is not governed by this policy. Your use of the RentCafe portal is governed by the RentCafe Privacy Policy, which is available at https://resources.yardi.com/legal/rentcafe-privacy-policy/. We encourage you to review that policy before providing any information through the portal. We do not control, and are not responsible for, Yardi’s collection or use of your personal information.

From Business Partners and Service Providers

We may receive personal data about you from other sources and combine that with information we collect directly from you. For example, we may obtain information about you from service providers that we engage to perform services on our behalf, such as property management platform providers and email platform providers.

How We Use Your Information

We use information that we collect about you or that you provide to us, including any personal data, to:

•      Provide you with the Services and any contents, features, information, products, or services that we make available through the Services.

•      Respond to your inquiries about our properties and services.

•      Fulfill any other purpose for which you provide it.

•      Improve our Services, including by analyzing your information and creating aggregated data derived from your information to develop, maintain, analyze, improve, optimize, measure, and report on our Services and their features and how users interact with them.

•      Carry out our obligations and enforce our rights arising from any contracts entered between you and us, including for billing and collection.

•      Notify you when service updates are available and about changes to any products or services we offer or provide through them.

•      In any other way we may describe when you provide the information.

•      For any other purpose with your consent.

The usage information we collect, whether connected to your personal data or not, helps us improve our Services and deliver a better and more personalized experience by enabling us to:

•      Estimate our audience sizes and usage patterns.

•      Store information about your preferences, allowing us to customize the Services according to your individual needs and interests.

•      Speed up your searches.

Your Rights and Choices About Your Information

This section describes mechanisms you can use to control certain uses and disclosures of your information and rights you may have under state law, depending on where you live.

Advertising, marketing, cookies, and other tracking technologies choices:

•      Cookies and Other Tracking Technologies. You can set your browser to refuse all or some browser cookies or other tracking technology files, or to alert you when these files are being sent. If you disable or refuse cookies or similar tracking files, some Services features may be inaccessible or not function properly. Some browsers include a “Do Not Track” (DNT) setting that can send a signal to the online services you visit indicating you do not wish to be tracked. Because there is not a common understanding of how to interpret the DNT signal, our Services may not respond to all browser DNT signals. Instead, you can use the range of other tools to control data collection and use, including the cookie controls and advertising controls, including the Global Privacy Controls, described in this policy.

•      Promotions by the Company. If you do not wish us to use your information to promote our own or third parties’ products or services, you can opt out by sending an email with your request to Office@rmcdev.com.

•      Targeted Advertising by the Company. If you do not want us to use information that we collect or that you provide to us to deliver advertisements according to our advertisers’ target audience preferences, you can opt out by sending an email with your request to Office@rmcdev.com.

•      Disclosure of Your Information for Third-Party Advertising. If you do not want us to share your personal data with unaffiliated or non-agent third parties for advertising and marketing purposes, you can opt out by sending an email with your request to Office@rmcdev.com. We do not control third parties’ collection or use of your information to serve interest-based advertising. However, these third parties may provide you with ways to choose not to have your information collected or used in this way. Your State Privacy Rights

Depending on your state of residency, you may have certain rights related to your personal data, including:

•      Access and Data Portability. You may confirm whether we process your personal data and access a copy of the personal data we process. To the extent feasible, data will be provided in a portable format. Depending on your state, you may have the right to receive additional information, and it will be included in the response to your access request.

•      Correction. You may request that we correct inaccuracies in your personal data that we maintain, taking into account the information’s nature and processing purpose.

•      Deletion. You may request that we delete personal data about you that we maintain, subject to certain exceptions under applicable law.

•      Opt Out of Targeted Advertising, Sales and Profiling. You may request that we not process your personal data for purposes of targeted advertising, the sale of personal data, or profiling in furtherance of decisions that produce legal or similarly significant effects concerning you.

List of Third Parties. Depending on your state of residency, you may request a list of the third parties to which we have disclosed or sold personal data.

Non-Discrimination. You have the right not to be discriminated against for exercising any of these rights. We will not deny you goods or services, charge you a different price, or provide you a different level of quality because you exercised your rights.

Sensitive Data. In states that require your consent before we process sensitive personal data, we will process sensitive personal data only with your consent or as otherwise permitted by law.

Opt Out of Using Personal Data for Sales, Targeted Advertising, and Profiling for Certain Legal or Similarly Significant Decisions. You may request that we do not use your personal data for these purposes. Some states may also grant you the ability to learn more about or challenge those automated decisions.

How to Exercise Your Rights; Verification. To exercise any of these rights, email your request to Office@rmcdev.com or write to us at the address in the “Contact Information” section below. To protect your information, we may need to verify your identity by asking you to provide information we can reasonably match against our records before we act on your request. We will not require you to create an account to submit a request. You may use an authorized agent to submit a request to opt out or to exercise other rights on your behalf; in that case, we may require written proof of the agent’s authorization and verification of your identity.

Timing. We will respond to your request without undue delay and within 45 days of receipt. When reasonably necessary, we may extend this period by an additional 45 days and will notify you of the extension and the reason for it within the first 45-day period.

Appeals. If we decline to take action on your request, we will tell you why, and you may appeal that decision by emailing your request to Office@rmcdev.com within a reasonable time. We will respond to your appeal in writing within 60 days of receipt. If we deny your appeal, then depending on your state of residency you may contact your state Attorney General to submit a complaint.

Some browsers and browser extensions support the Global Privacy Control (“GPC”) that can send a signal to process your request to opt out from certain types of data processing, including data “sales” as defined under certain laws. When we detect such a signal, we will make reasonable efforts to respect your choices indicated by a GPC setting as required by applicable law.

Additional Information for California Residents. In the preceding 12 months, we have collected the categories of personal data described in “The Personal Data That We Collect or Process,” from the sources described in “How We Collect Your Personal and Other Data,” for the business and commercial purposes described in “How We Use Your Information,” and we may disclose those categories of personal data to the categories of third parties described in “Who We Disclose Your Information To.” We have not sold or shared (for cross-context behavioral advertising) California residents’ personal data, and we have not used or disclosed sensitive personal data for purposes that would require us to offer a “Limit the Use of My Sensitive Personal Information” option. Because we honor Global Privacy Control opt-out preference signals, we treat a valid signal as a request to opt out of any sale or sharing of personal data. California residents also have the right to know, delete, and correct their personal data and the right not to be discriminated against for exercising their rights.

 

How We Protect Your Personal Data.

We use commercially reasonable administrative, physical, and technical measures designed to protect your personal data from accidental loss or destruction and from unauthorized access, use, alteration, and disclosure. However, no website, mobile application, system, electronic storage, or online service is completely secure, and we cannot guarantee the security of your personal data transmitted to, through, using, or in connection with the Services. In particular, emails and texts sent to or from the Services may not be secure, and you should carefully decide what information you send to us via such communications channels. Any transmission of personal data is at your own risk.

Nevada provides its residents with a limited right to opt out of certain personal data sales. Residents who wish to exercise their sale opt-out rights may submit a request to Office@rmcdev.com. However, please know we do not currently sell data triggering that statute's opt-out requirements.

If you are a California resident, additional information may apply to you. California law, including the California Consumer Privacy Act (CCPA), may provide you with additional rights regarding your personal information, including the right to know what personal information we collect, the right to delete your personal information, and the right to opt out of the sale or sharing of your personal information. To the extent RMC meets the CCPA's jurisdictional thresholds, we will comply with all applicable CCPA requirements. California Wiretapping and Electronic Communications Disclosure. California law, including the California Invasion of Privacy Act (California Penal Code Sections 630-638.55) ("CIPA"), restricts the interception or recording of confidential communications without the consent of all parties to the communication. Our Services do not intentionally intercept, record, or monitor any confidential electronic communications between you and our website, except as described in this policy (for example, through the use of cookies and analytics technologies described above). By using our Services, you acknowledge the data collection practices described in this policy. The safety and security of your information also depends on you. You are responsible for taking steps to protect your personal data against unauthorized use, disclosure, and access.

How We Retain Your Personal Data

We keep the categories of personal data described in this policy for as long as reasonably necessary to fulfill the purposes described or as otherwise legally permitted or required, such as maintaining the Services, operating our organization, complying with our legal obligations, resolving disputes, and for safety, security, and fraud prevention. This means that we consider our legal and business obligations, potential risks of harm, and the nature of the information when deciding how long to retain personal data. The criteria we use to determine the retention period for each category of personal data include the nature and sensitivity of the data, the purposes for which we process it, and our legal, accounting, and regulatory obligations. For example, analytics data collected through Google Analytics is retained for 12 months. We do not retain any category of personal data, including sensitive personal data, for longer than reasonably necessary for the disclosed purpose. We do not collect, use, or sell your personal data for the purpose of training large language models. At the end of the retention period, personal data will be deleted, destroyed, or de-identified.

Changes to Our Privacy Policy

We may update this policy from time to time, and we will provide notice of any such changes to the policy as required by law. The date the privacy policy was last updated is identified at the top of the page. We will notify you of changes to this policy by updating the “last updated” date and posting the updated policy on the Services.
